District Court for the District of Columbia ruled that e-cigarettes did not meet the criteria for drug-delivery devices and therefore were exempt from regulation under the FFDCA. The court did rule, however, that the FDA could regulate e-cigarettes as tobacco products under the Family Smoking Prevention and Tobacco Control Act (TCA), since the nicotine contained in some of the e-cigarette cartridges was derived from tobacco. Vaping has exploded into a national crisis, and tobacco companies are helping to fuel it by targeting kids with flavors such as gummy bear and cotton candy. E-cigarette companies have promoted unsubstantiated health claims about their products as healthier than traditional cigarettes, when, in fact, e-cigarettes are uniquely dangerous for kids due to nicotine’s impact on their developing brains. Since being introduced to the U.S. market in 2007, e-cigarette use among youth has increased to epidemic levels (Surgeon General's Advisory on E-cigarette Use Among Youth, 2018). The availability of flavored e-cigarettes is one of the most commonly cited reasons for e-cigarette use among youth (Tsai et al., 2018). Given the importance of flavors contributing to use of e-cigarettes among youth, these data briefs build on this previously published article, providing an update on trends in unit sales of e-cigarettes in the U.S. by product and flavor type.
It would seem that future studies should analyse the possible toxic effects of humectants and related products at concentrations similar to those that e-cigarette vapers are exposed to reach conclusive results. Due to what has been called an ‘epidemic’ of youth use of these products, FDA has prioritized prevention efforts. The researchers concluded that vaping with and without nicotine disrupts typical lung function in otherwise healthy people. This data highlights a small part of a larger issue, despite the ban on e-cigarettes and vapes in India under the Prohibition of Electronic Cigarettes (Production, Manufacture, Import, Export, Transport, Sale, Distribution, Storage, and Advertisement) Act, 2019. The Annual Review of Physiology article summarizes what is known—and highlights where gaps in knowledge exist—about e-cigarettes and harm to the lungs. The review discusses the range of effects found in rigorous studies, including shorter-term acute effects and longer-lasting chronic impacts. As substantiated in the review, a convincing body of evidence exists that confirms e-cigarettes cause lung inflammation and injury, as well as negative health effects in multiple organs.
